About the Role
Reporting functionally to the Commercial Director and operationally to the Project Manager / Operation Manager / General Manager / District Manager, the Commercial Manager is accountable for providing contractual, financial, and commercial support to pre-construction team and project teams. The incumbent is responsible for managing all contractual and commercial aspects of project(s) assigned within the Business Unit with aggregate annual project revenues for the Business Unit. Key functions include providing advice on contractual, commercial, risk, and opportunity matters, ensuring the timely completion and profitability for all projects within the Business Unit, and managing and mentoring other commercial managers, project commercial managers, commercial coordinators, and project team personnel.
As Commercial Manager for Graham you will:
- Review RFQ / RFP or bid / tender documentation to allow recommendations to be made to (line) management in regard to submitting qualifications and proposals.
- Conduct Prime Contract reviews to identify contract and commercial risks / opportunities which need to be considered in the bid and the resulting project.
- Ensure RFQ / RFP or bid / tender documentation submissions are compliant and risks are properly identified and addressed within the submissions.
- Liaise with Graham areas of expertise (Risk Management and Legal, etc.) when reviewing bid documentation.
- Assist in the preparation of bespoke or modified Graham Designer Teaming Agreements, Design Services Agreements, and Professional Services Teaming Agreements as required, and obtain the necessary approvals required prior to the finalization of such agreements.
- Assist in the preparation of other agreements (Integrated and Non-Integrated Joint Venture Agreements, etc.) as required.
- Collaborate with Pre-Construction team members in preparing, revising, and monitoring information regarding reports related to costs involved in developing the tender budget.
- Provide advice on performance security and insurance and seek approval from Graham areas of expertise (Risk Management and Legal).
- Manage the project’s commercial administration and financial operations, and mentor and support the project team throughout the project lifecycle to ensure that contractual obligation compliance is maintained.
- Review in detail the Monthly Actual and Projected Project Cash Positions, Revenue Projections, Cost Control / Projections (forecasting), Profit & Loss Reports, Actual Performance to Budget, and Risk & Opportunity position on projects.
- Report regularly (frequency to be not less than monthly) to (line) management on the Cash Management, Revenue Projections, Cost Control / Projections (forecasting), Profit & Loss Reports, Projections & Budgets, and Risk & Opportunity functions on projects.
- Ensure compliance with the published procedures, including delivering training and mentoring to the project team in the writing of scopes of work, inclusions, exclusions, etc.
- Support the project team with the preparation, negotiation, and approval of all Prime Contract and sub-trade change order requests, ensuring that change order request tracking is up to date and complete, and that the schedule impact of the changes is included.

- Oversee contracts and commercial performance of projects in order to maximize margins and contribute to the success of the strategies as defined by the Senior Leadership team.
- Advise and report regularly to (line) management on contractual and commercial matters.
- Advise and report regularly to (line) management on risk and opportunity matters.
- Liaise with Legal and Risk Management on contractual and insurance matters.
- Provide contractual and commercial support and direction to the project teams.
- Support pre-construction and project execution in commercial matters.
- Provide advice on or participate in the post-tender pre-contract negotiations.
- Provide input into the completion of an organizational and responsibility matrix at the start of the project.
- Apply expertise to ensure proper project planning, scheduling, staffing, cost control, and project management.
- Assist in ensuring that the project team understands the deliverables and obligations of the Prime Contract.
- Assist in the input of regular status reports for management and project steering committees (as applicable), detailing status of the project and recommending actions to be taken.
- Oversee and report regularly to (line) management on the Cash Management, Cost Control / Projections, Profit & Loss Reports, Projections & Budgets, and Risk & Opportunity functions on projects within the Business Units.
- Delegate tasks as necessary and intervene when issues arise or high-profile considerations are identified.
- Establish and maintain relationships with public and private sector clients, construction joint-venture partners, financing partners, and key specialist subcontractors.
- Build effective relationships with customers, design team, subcontractors, suppliers, and user groups that reflect and support Graham core values.
Qualifications/Experience:
- Degree in Construction Management, Engineering, Quantity Surveying, Business, or a related field.
- 10+ years of construction and commercial management experience working on large ($100M+) construction projects, including stewardship of all contract terms and conditions.
- Advanced knowledge of construction contract administration and the principles of purchasing, finance, and estimating.
- Strong negotiation skills, including resolution of deficiencies and / or claims.
- Thorough understanding of contract law and detailed experience working with various contract types and forms.
